Anti-American Protests: Flag Burning and Death-to-America Rhetoric

Anti-American Protests: Flag Burning and Death-to-America Rhetoric

1989: Texas v. Johnson held that flag burning can be protected expression. True threats, incitement and violence are not. In April 2024, Columbia and NYU saw arrests after building and policy breaches, yet NY reporting found many of the ~228 arrestees ended up with no lasting criminal record. Campus chants included eliminationist and anti-American slogans, and discipline was uneven.

PRO: Ugly speech tests liberal democracy; arrests for crime, not viewpoint bans, are the proper tool.

CON / COST: Selective enforcement and assaults on flag-carriers go beyond speech.

SOCIETY: BAD

10-Minute Lazy Voter Guide

Who’s for / against: Defend as protected protest: ACLU-style free-speech absolutists, many campus left groups. Oppose toleration/celebration: Republicans, veterans’ groups, many Democrats after Oct 7 campus scenes; universities that eventually called police on encampments.

Speech-protection arguments

Civic-order arguments

+ Texas v. Johnson: flag burning can be protected expression

+ Ugly speech is a test of liberal democracy

+ Arrests for trespass/violence are the proper tool — not viewpoint bans

– ‘Death to America’ from students at elite schools signals civic failure

– Selective enforcement: similar rhetoric from other factions treated differently

– Violence, assaults on flag-carriers, and building takeovers exceed speech

Verdict for voters: Protect pure speech; punish crime; culturally reject hatred of the country that funds the campus. Tolerating assaults on students carrying US flags is not liberalism — it is thuggery. Flag burning may be legal and still contemptible.

1. What is the policy

Item

Detail

Assessment

Constitutional baseline

Flag desecration as symbolic speech often protected (Texas v. Johnson, 1989); true threats/incitement/violence not protected.

Substantiated

Campus practice 2023–24

Encampments, chants including eliminationist and anti-American slogans; uneven discipline (see antisemitism page).

Substantiated pattern

Municipal response

Arrests for trespass/disorderly conduct sometimes followed by dropped records (e.g., NY reporting on Columbia/NYU arrests).

Reported

2. Why it exists

Stated reasons: protest US foreign policy; anti-imperialism; free expression.

Underlying drivers: Radical campus ideologies; foreign-influenced agitprop in some networks; administrative fear; media romanticization of protest. Corruption: some funded activist ecosystems — follow NGO money — but many chanters are sincere radicals. Manipulation of double standards (speech for me, not for thee) is the governance failure.

Campus encampments

Columbia/NYU Apr 2024 arrests after building/policy breaches

Substantiated

Assault on US-flag carrier

Chants

Death-to-America / eliminationist slogans at protests

Reported widely; clip-verify case-by-case

Legal outcomes

Many arrestees without lasting criminal records (NY Post on ~228)

Reported

Law vs culture

Lawful hateful speech can be legal. Universities and cities still choose whether to platform, fund, and soft-pedal it. Cultural toleration of "Death to America" at institutions built by American taxpayers is a values failure even when the First Amendment bars criminalization of the chant alone.

4. Good or bad for society

Direct judgment: Legal speech ≠ good citizenship. Society should protect the right to burn a flag and still fire, expel, or socially shame those who assault neighbors or cheer America’s death. The scandal is selective cowardice — not the First Amendment.

  1. Arrest and prosecute violence/trespass consistently
  2. No student-group funding for orgs that endorse terrorist groups
  3. Teach civic literacy: rights come with a country worth keeping
